These Terms & Conditions ("Terms") govern your access to and use of our website, our text messaging (SMS) program, and any related services we provide.

By accessing this website, submitting a form, calling or texting our community, or otherwise interacting with our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Who We Are

Golden Pond is a senior living community located at 1270 N Ford Street, Golden, CO 80403. We offer Independent Living, Assisted Living, and Memory Care.

2. Eligibility and Acceptance

You must be at least 18 years of age to submit information through this website, opt in to our SMS program, or engage our services on behalf of yourself or a prospective resident. By using our website or services, you represent that you meet this requirement and that any information you provide is accurate and that you have authority to share it.

If you are providing information about another person (such as a parent or family member who may become a resident), you represent that you are authorized to share that information and to receive communications on their behalf.

3. Informational Purposes Only

The content on our website — including descriptions of living options, amenities, pricing ranges, care services, and lifestyle programming — is provided for general informational purposes. Information on our site is not a guarantee of availability, eligibility, pricing, or specific outcomes.

Actual pricing, room availability, care assessments, and contractual terms are determined through our admissions process and documented in the Residency Agreement signed at move-in. Marketing materials, blog posts, and website content do not constitute a contract or offer.

Nothing on this website is intended as medical, legal, financial, tax, or professional advice. Decisions about senior care should be made in consultation with appropriate licensed professionals.

4. Tours, Inquiries, and Communications

When you submit a form, request a tour, or otherwise contact us, you authorize our team to follow up by phone, text message, and email regarding your inquiry. Our communications may include scheduling, pricing discussions, care information, and follow-up over a reasonable period as we help you evaluate whether Golden Pond is the right fit.

You can opt out of any communication channel at any time:

  • Email: click "unsubscribe" in any email or contact us directly
  • Text: reply STOP (see Section 6)
  • Phone: request to be removed from our follow-up list during any conversation or by emailing info@goldenpond.com

5. Call Recording and Monitoring

Calls to and from Golden Pond may be recorded or monitored for quality assurance, training, regulatory compliance, and to maintain accurate records of your inquiry. Colorado is a one-party consent state for call recording, and by continuing a call with our team, you consent to the recording.

If you do not wish to be recorded, please notify the team member at the start of the call and we will accommodate your preference where operationally possible.

6. SMS / Text Messaging Program

6.1 Program Description

We offer a text messaging program to help prospective residents, families, and current residents communicate with our community team. Messages may include:

  • Responses to inquiries you have submitted
  • Tour scheduling, confirmations, and reminders
  • Follow-up from our sales counselors and Executive Director
  • Information about pricing, availability, and care options you have requested
  • Move-in coordination for new residents
  • Important community updates relevant to your inquiry

This is a customer care and informational program. We do not send unsolicited marketing or promotional text messages.

6.2 How to Opt In

You may opt in by:

  • Submitting a web form with a checkbox or statement authorizing SMS communication
  • Replying to a text message from one of our numbers
  • Verbally consenting during a phone call and confirming your mobile number
  • Texting our published community number directly

By opting in, you confirm you are the subscriber of the number provided or are authorized to opt in on behalf of the account holder.

6.3 Message Frequency

Message frequency varies based on your interaction with our team. Expect messages only in connection with an active inquiry, tour, or conversation you have initiated.

6.4 Message and Data Rates

Message and data rates may apply, depending on your wireless carrier and plan. Golden Pond is not responsible for charges from your mobile carrier.

6.5 How to Opt Out

Reply STOP to any text message to cancel. You will receive a confirmation message, and we will stop sending texts unless you opt in again. Reply HELP for help, or contact us at (303) 271-0430 or info@goldenpond.com.

6.6 Carriers

Supported carriers include AT&T, Verizon Wireless, T-Mobile, U.S. Cellular, Boost Mobile, MetroPCS, Cricket Wireless, and most other major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

6.7 Mobile Information Privacy

We will not sell, rent, share, or otherwise disclose your mobile phone number or text message content to third parties for their marketing or promotional purposes. Mobile information, including phone numbers and SMS consent, is used solely to deliver the messaging services you have requested. We may share information with service providers (such as our telecommunications platform and customer relationship management system) strictly as necessary to operate the SMS program. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

6.8 Not for Emergencies

Our SMS program is not monitored 24/7 and is not for emergencies. In an emergency, call 911. For after-hours resident care concerns, call the Community directly.

6.9 Sensitive Information

Please do not send protected health information, Social Security numbers, financial account numbers, or other highly sensitive data via text. SMS is not a secure channel.

6.10 Consent Is Not a Condition

Your consent to receive text messages is not a condition of touring, applying for residency, or receiving any service from us.

7. Privacy

Your use of our website and services is also governed by our Privacy Policy, which describes how we collect, use, share, and protect your information. By using our services, you consent to the practices described in the Privacy Policy.

8. Intellectual Property

All content on this website — including text, photos, video, graphics, logos, the Golden Pond name and marks, the Stage Senior name and marks, page layout, and underlying code — is owned by Stage Senior Management, LLC, our communities, or our licensors, and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may view and print content for personal, non-commercial use only. You may not copy, reproduce, republish, modify, distribute, scrape, frame, mirror, or create derivative works from any content on this site without our prior written permission. The use of automated systems (bots, scrapers, crawlers) to extract content for commercial purposes is prohibited.

Resident and family photos appearing on our website are published with consent. If you appear in a photo and wish to have it removed, contact us at info@goldenpond.com.

9. User-Submitted Content

If you submit reviews, testimonials, photos, comments, or other content to us (whether on our website, on review platforms we monitor, or via email or text), you grant Stage Senior Management, LLC and Golden Pond a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, and display that content in our marketing and on our websites, with attribution as appropriate.

They are not guarantees of future results or representative of every resident's or family's experience. Pricing ranges quoted in reviews or older marketing materials may no longer be accurate.

12. Health, Safety, and Care Disclaimers

Senior living involves individualized care decisions that depend on each prospective resident's health, abilities, and circumstances. Golden Pond provides assisted living and/or memory care services under licensure from the Colorado Department of Public Health and Environment, as applicable to our license type. We do not provide skilled nursing care unless specifically noted, and we do not guarantee any particular health, cognitive, or safety outcome.

Care services, eligibility, and pricing are determined through our admissions assessment process and documented in the Residency Agreement, which controls in the event of any conflict with website content.

13. Pricing Information

Pricing ranges displayed on our website are starting points and are subject to change. Final pricing depends on apartment selection, level of care assessed, and current availability, and is documented in the Residency Agreement.

14. Equal Housing Opportunity

Golden Pond complies with the Fair Housing Act and all applicable federal, state, and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, national origin, familial status, disability, sexual orientation, gender identity, source of income, or any other protected class.

15. Prohibited Conduct

Our total cumulative liability arising from or relating to your use of this website shall not exceed one hundred U.S. dollars (USD $100).

These provisions do not limit any rights you may have as a senior living resident under your Residency Agreement or under Colorado state regulations governing senior living communities.

We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Continued use of our website or services after we post changes constitutes your acceptance of the revised Terms. For material changes affecting the SMS program, we will provide notice consistent with applicable law.

21. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of our website and our SMS program, and supersede any prior agreements. They do not supersede the Residency Agreement or any other written contract you sign with the Community.
